i mean, dude, i was on your side on that thread, but i did say that if two people are truly equal partners, as i stipulated in this standard, then a 50/50 split is justifiable. but youre right there was no consensus, so what do you want me to say? i personally think, provided the workload and creative control is 1:1, then a 1:1 royalty split is justifiable on the basis that royalties ties more to ownership of the project and less to actual labour hours. you can try to change my mind, but your opinion being different wont change whats on the list.
this debate is also why i included the 'there is an open discussion abt royalties' point - the artist and writer need to come to a consensus themselves abt what the best practice is. so long as both parties are willing to negotiate, i think thats a good sign.
i mean... royalties... exist. as a thing. so we do have to decide how to split them. but elaborate
i mean, this is an absolute maximum, but id be willing to cut that down to 50. its a difficult one bc it depends on the style. and as far as i care page means page, convertible to a 4-8 panel rate in infinite scroll, and amount of effort is something to be negotiated individually.
im not trying to find a compromise on marketability, im just giving leeway for different situations. two very experienced artists who are already very familiar with eachother may feel prepared to do 100. although im leaning towards cutting it down to 50 pages.
maybe we see collaboration different. i see a guest artist as smth far less collaborative than a one on one, and is absolutely not what this list is looking at - and this list has basically written off all cold call collaborations as a warning sign. maybe thats what i should make clearer.
i dont have the same faith in general consensus that you have. if someone on the forums disagrees with a certain guideline but i still think its right, i will keep it in. if someone noted a point i thought was wrong, i would leave it out. this is, still, my list, even if im inviting notes. and what i posted in the OP was a first draft - as made clear by the several addendums - so OF COURSE the language was vague. thats why we're developing it now.
im not against specifics, so im not sure why youre talking to me like i am.
also, this manipulation thing... i just dont believe thats as large a risk as you think it is. and this wasnt intended to be a 'if alll these boxes are ticked go right ahead!!' kind of thing. discretion is still advised at all times. every situation is unique - THATS WHY ITS VAGUE! because i cannot create something that covers every situation in absolute terms. this was intended to be a LOOSE guideline. ill make that clearer in the OP, but this conversation about manipulation of the points will end at this: i disagree, and i dont want you to try and change my mind.
