like if it's specifically about like the one guy from like wii sports boxing or the other one from wii sports resort swordplay then it being based on something you didn't make is probably fanfic

if you reference stuff within the mii universe like the webstore or sports or other nintendo IPs then yeah it's fanfic. If you're just using the mii maker as a character maker to make a hero with a story completely independant of nintendo IPs it's original fiction. (I made original characters for an independant story based off animal crossing outfits)
